2016 SOCIALITE BURTONGIRLS GRAPHIC CONTEST
Eligibility: The 2016 Socialite BurtonGirls Graphic Contest (“Contest”) is open worldwide to entrants who are 18 years of age and older at the time of entry. This Contest is void in Puerto Rico and where prohibited by law. Subject to all federal, state and local laws.
Agreement to Comply with Official Contest Rules: Participation in the Contest constitutes your full and unconditional agreement to and acceptance of these Official Contest Rules, and the decisions of Burton Snowboards, which are final and binding. Winning a prize is expressly contingent upon fulfilling all requirements set forth herein.
Entry Period: Contest begins on 12/27/13 at 12:00:01 AM Eastern Time (ET) and ends on 1/20/14 at 11:59:59 PM (ET) (“Contest Period”).
How to Enter: Please send all photos by email to info@ burton.com. Each person who submits an Entry is hereinafter referred to as an “Entrant”. Entry and continuing participation in the Contest is subject at any time to verification by Burton. Once an Entry is submitted, it may not be edited or resubmitted. No correspondence regarding the screening, verification or judging status of Entries will be undertaken by Burton Snowboards, except as specified in these Official Contest Rules.
Entrant’s Representations and Warranties: By submitting an Entry, you represent and warrant that: (a) the Entry is an original work created solely by you; (b) you own all rights to the Entry; (c) to the extent the Entry depicts any individual, you are the individual pictured in the submission, or, alternatively, that you have obtained written permission from each person appearing in the Entry and can make written copies of such permissions available to Burton upon request; and (d) the Entry complies with all requirements of these Official Contest Rules.
Entrant irrevocably and in perpetuity assigns to Burton Snowboards all worldwide right, title and interest in and to any Creation. As used herein, “Creation” means any concept, artwork, design, image, model, or the like produced and submitted by Entrant in the Contest. Burton Snowboards has the sole and exclusive right to apply, reproduce, prepare derivative works, distribute copies, perform, display and license to third parties such submitted Creations, without any obligation, financial or otherwise, to the Entrant.
Entrant acknowledges that there is the possibility that elements pertaining to his/her submission may resemble or be identical to designs developed by Burton Snowboards, its agencies, its licensors, or other Entrants. Entrant acknowledges that Burton Snowboards bears no responsibility and is not liable to the Entrant in relation to the use of the Creations or elements of the Creation, even if said Creations or elements of the Creation substantially resemble or are identical to designs developed by Burton Snowboards, its agencies, its licensors, or other Entrants.
Additional Content Requirements: Additionally, to be eligible for a Contest award, an Entry must meet the following additional requirements
- Entry may not have been previously published or entered in any promotion.
- Entry may not include any third-party intellectual property.
- Entry may not violate any third-party intellectual property rights, including, but not limited to, copyrights, trademark rights, or rights of privacy and publicity.
- Entry may not depict Burton Snowboards or its products and services unfavorably.
- Entry may not violate individual rights of privacy.
- Entry may not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age.
- Entry may not contain material that is unlawful, in violation of or contrary to the laws or regulations in any state or promote violation of such laws.
Winners: Winners will be chosen at the sole discretion of Burton Snowboards. The winning Entries will be used as a graphic on one or more snowboards in the 2016 snowboard line. If chosen, each winner will receive a free snowboard with his/her winning Entry.
Requirement of the Winner: Winners may be required to sign and return a Release of Liability in which the winner irrevocably assigns and transfers to Burton Snowboards any and all right, title, and interest in his/her Entry and Creation, including, without limitation, all copyrights and trademark rights. Required documents are due within ten (10) days of notification by Burton Snowboards. Any taxes associated with prizes shall be the sole responsibility of the Winner.
General: By participating in the Contest, Entrant agrees to release and hold harmless Burton Snowboards, and each of its respective officers, directors, employees, affiliates, agents, and subsidiaries (collectively the “Released Parties”), from and against any and all liability with respect to participation in the Contest or acceptance or use (or misuse) of a prize or participation in any prize-related activities or any use of the Entry or Creation submitted by Entrant. Entrant agrees to release, defend, indemnify and hold harmless Released Parties from and against, and accept all responsibility of any kind, including but not limited to financial, for any liability, claims, losses, damages or proceedings, including, but not limited to death, (including reasonable attorneys’ fees) relating to any actions taken by Entrant, including without limitation, all warranties relating to participation and entry in the Contest and use of Entrant’s e-mail or other identification purporting to act on Entrant’s behalf in regard to the Contest (whether or not such use occurred with or without your permission). Entrant also agrees to release, defend, indemnify and hold harmless the Released Parties from any and all liability, claims, losses, damages or proceedings (including reasonable attorneys’ fees) relating to Contest prize consideration and Contest publicity, and any other matter in connection with Entrants’ participation in the Contest.
Released Parties are not responsible for lost, late, delayed or incomplete Entries. In the event a dispute arises regarding a specific individual entitled to receive a prize, entry in the Contest will be declared made by the “authorized e-mail account holder.” “Authorized e-mail account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entrant may be requested to provide Burton Snowboards with proof that he/she is the authorized e-mail account holder of the e-mail address associated with the submission. Proof of submission will not be deemed proof of receipt by Burton Snowboards.
Disputes: Burton Snowboards reserves the right to make all decisions in its sole discretion arising out of or relating to this Contest, and the decisions by Burton Snowboards are final and binding. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Contest Rules, your rights and obligations, or the rights and obligations of Burton Snowboards in connection with this Contest, shall be governed by, and construed in accordance with, the laws of the State of Vermont, without giving effect to any choice of law rules, which would cause the application of the laws of any jurisdiction other than State of Vermont. By participating in this Contest, you agree that Vermont will be the exclusive forum for any formal dispute resolution.
PUBLICITY: By participating in Contest, you grant Burton Snowboards an exclusive, irrevocable license to use, alter, adapt, publish, distribute, copy, display, promote, advertise, publicize and otherwise exploit your Entry, including your name and other entry materials, as well as additional photographs, video footage or other images that Burton Snowboards may take of you if you are the winner, in any manner and for whatever purpose Burton Snowboards shall elect, and in any and all media now known or hereinafter developed, including but not limited to, website (including Facebook), television, and/or printed materials, worldwide in perpetuity, without compensation, notification or permission. You shall not claim or be entitled to receive any compensation or credit for such use.
